These Terms of Service (“Terms”) govern the advisory and strategic growth consulting services provided by GetFound.id (“we,” “us,” or “our”).

By engaging us, whether through written agreement, purchase order, or online form, you (“Client” or “you”) agree to be bound by these Terms.

Our role is to act as your strategic growth partner, providing data-driven insights, market positioning strategies, and performance acceleration plans designed to achieve measurable business outcomes.

1. Scope of Engagement

We provide high-level consulting and execution support, which may include:

• Strategic growth planning & market expansion advisory
• Data-driven marketing campaigns (SEO, Paid Media, Social)
• Funnel optimization & conversion rate consulting
• Brand positioning & messaging strategies
• Marketing automation & analytics implementation
• Executive-level performance reviews and growth advisory

The specific deliverables, timelines, and fees will be detailed in a signed Engagement Agreement or Statement of Work (SOW). Any additional work outside the agreed scope will require a separate written agreement and may incur additional fees.

2. Client Commitments

To ensure effective results, you agree to:

• Provide accurate, complete, and timely information necessary for project execution.
• Grant access to accounts, data, and platforms as required.
• Review and approve recommendations, deliverables, and reports promptly.
• Ensure all campaigns and materials comply with applicable laws, regulations, and platform policies.
• Maintain necessary licenses, permits, and approvals for your business activities.

You are solely responsible for the accuracy, legality, and appropriateness of all content, data, and instructions provided to us.

3. Professional Fees & Payment Terms

• Fees, milestones, and payment schedules will be set out in the Engagement Agreement or SOW.
• All invoices are payable within [e.g., 14 days] of the invoice date unless otherwise stated.
• Late payments may incur interest at 1.5% per month and may result in suspension of services.
• Work will not commence (or will pause) until agreed payments are received.
• All fees are exclusive of applicable taxes, which will be added where required.

4. Strategic Insights & Intellectual Property

• All proprietary methodologies, frameworks, tools, and processes remain our intellectual property.
• Upon full payment, you are granted a non-exclusive, non-transferable license to use deliverables solely for your internal business purposes.
• We reserve the right to use non-confidential and anonymized project results, metrics, or case studies for portfolio and marketing purposes, unless otherwise agreed in writing.

5. Confidentiality

Both parties agree to maintain the confidentiality of all non-public business, technical, or financial information received during the engagement, except where disclosure is required by law or expressly permitted in writing.

6. Use of Third-Party Platforms

Our strategic recommendations may require the use of third-party tools and services. You acknowledge and agree that:

• We are not liable for outages, errors, or changes to third-party services.
• You are responsible for any third-party fees unless otherwise agreed.
• You must comply with any terms set by those third-party providers.

7. No Guarantee of Specific Outcomes

While we are committed to delivering measurable growth strategies, we cannot and do not guarantee:

• Specific search engine rankings
• Exact revenue or conversion targets
• Market share increases
• Performance unaffected by external factors (e.g., algorithm changes, competitor actions, economic shifts)

8. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages.
• Our total liability in connection with the services shall not exceed the total fees paid to us in the 90 days preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your breach of these Terms
• Your misuse of our deliverables or recommendations
• Any third-party claim related to your products, services, or marketing materials

10. Termination

• Either party may terminate the engagement with [e.g., 30 days] written notice.
• Termination does not relieve you of the obligation to pay for services rendered up to the termination date.
• In the event of early termination, partially completed strategic assets may not be delivered until payment is made in full.

11. Governing Law

These Terms are governed by the laws of Indonesia, without regard to conflict of law principles.

We may update these Terms periodically. Any updates will be posted on our website with the revised “Effective Date.” Continued use of our services after changes are posted constitutes acceptance of the updated Terms.
